™ vs ® — which symbol can I use?
A quick, practical guide to the two trademark symbols and when you can legally use each in Australia.
™
Anyone can use it. The ™ symbol simply claims that you regard something as your trademark — registered or not. You can start using ™ on your brand from day one, including while your application is pending.
®
Registered marks only. The ® symbol means the mark is officially registered in Australia. It is an offence to use ® on a mark that is not registered.
The rule of thumb
Use ™ while you build your brand and during the application process. Once your trademark is registered, switch to ®. If you registered overseas but not in Australia, you may only use ® here if you show the country of registration alongside it.
